By using this site you agree to be bound by these terms:

• New Zealand Law: The information contained on this site has been prepared in accordance with New Zealand law for the supply of products and services in New Zealand only.
• General Information: The information on this site is for general information only. Although every effort has been made to ensure that the information is current and accurate, the information is selective and may not be complete or suitable for your intended use.
• Subject to Change: The information on this site may be changed at any time. These terms and conditions are in addition to and do not replace any terms and conditions for BNZ accounts, products or services.
• Liability: Subject to any applicable law which cannot be excluded and to all provisions implied by statute which cannot be excluded, BNZ accepts no responsibility for any loss, damage, cost or expense (whether direct or indirect) incurred by you as a result of any error, omission or misrepresentation in any information in this site or our failure to provide this site.
• No Deemed Consent: Publication of email addresses should not be taken as deemed consent to receiving unsolicited email.

Project Submission Terms & Conditions

Project Submissions

There is no limit to the number of submissions you can make. Submissions close on 27 September 2009 at 11.59pm. Submissions received after this date will be ineligible.

BNZ reserves the right to verify the validity of submissions.

Submissions will be promoted in print and online media such as, but not limited to, www.closedforgood.org, www.twitter.com, and the Closed for Good email updates.

Selection of projects

The successful projects will be chosen by BNZ by 12 October in its absolute discretion.  BNZ’s decision will be final and no correspondence will be entered into.

Successful applicants will by notified by phone and details may be published on www.closedforgood.org. Unsuccessful applicants will be notified by email.

Content and intellectual property

Your submission must not contain any material which is indecent, inappropriate, derogatory, infringes any third party’s intellectual property rights, or is otherwise contrary to the law.

Your submission and any copyright or other rights therein, becomes (to the extent permitted by law) the property of BNZ once you have submitted it.

BNZ is the proprietor or has the right to use the copyright, trade marks and all other intellectual property rights in all software, text, graphics and other material displayed, on, or available through, the Closed for Good website.

Personal information and privacy

Your personal information is collected in order to allow BNZ to conduct Closed for Good and to contact you via email, text message, an online facility, by telephone or post, with information concerning your submission and Closed for Good generally.

You agree

By submitting your submission you agree that:

• BNZ may publish your name, city of residence, the name of the person or organisation the project is to benefit, the content of your submission and any statement made by you concerning your submission and BNZ may use  any of the same for promotional and/or media purposes;

• BNZ may publish any images, footage or interviews taken by BNZ while carrying out the project, if your submission is successful, and BNZ may use any of the same for promotional  and/or media purposes;

• You have, or will (if your submission is successful), obtain any third party consents and permits required to undertake your project e.g. landlord consents, school consents, Department of Conservation consents, local body consents, building permits etc; and

• You will take all practicable steps to ensure the safety of BNZ staff working on your project and if required by BNZ, you agree to fulfill all health and safety obligations reasonably requested by BNZ.

Liability

Any services or advice provided by BNZ staff, on the Closed for Good day, are provided by them in their personal capacity only and BNZ is not responsible for those services or advice.

BNZ and its staff will not be liable, in contract, tort or otherwise, for any damage, loss (regardless of whether or not that loss is direct or indirect, the cause of such loss or whether BNZ or its staff have been advised of the possibility of such loss), or personal injury, however suffered, which is related to, or results from, your submission, participation in Closed for Good or use of this website.

These terms are governed by the laws of New Zealand, and the parties submit to the exclusive jurisdiction of the New Zealand courts.
